UPDATE ON LITIGATION: - TENAGA NASIONAL BERHAD VS GAMUDA WATER SDN BHD SHAH ALAM HIGH COURT SUIT: 1. SUIT NO. BA-22NCVC-100-03/2018 ("SUIT 1") 2. SUIT NO. BA-22NCVC-101-03/2018 ("SUIT 2") 3. SUIT NO. BA-22NCVC-102-03/2018 ("SUIT 3") 4. SUIT NO. BA-22NCVC-103-03/2018 ("SUIT 4") (COLLECTIVELY "TNB SUITS")
Reference is made to the announcement made by Gamuda Berhad (Company No. 29579-T) (“Gamuda” or “Company”) on 9 March 2018 pertaining to the TNB Suits.
The Company wishes to update that at the Shah Alam High Court Hearing today, 5 June 2018, the presiding Judge has given the following directions to the solicitors representing its 80% owned subsidiary, Gamuda Water Sdn Bhd (Company No. 297031-H) (“Gamuda Water”): -
- by consent, the TNB Suits are consolidated and to be heard together;
- Suit 1 shall be the main suit and amendments has to be made to the intitulement to include Suit 2, Suit 3 and Suit 4;
- Gamuda Water is to file an Application for the Stay of Proceedings by 11 June 2018; and
- Tenaga Nasional Berhad (Company No.200866-W) to withhold the Application for Summary Judgment until the disposal of the Stay Application.
The Case Management for the TNB Suits has been fixed on 14 June 2018.
Gamuda will make the appropriate announcements to Bursa Malaysia Securities Berhad as and when there are material developments in relation thereof and/or upon receipt of the court’s decision. Any updates on the TNB Suits including hearing dates will be disclosed in the quarterly results of the Company.
